Terms of Service

1. Description of the Service

FitBot AI is an AI-powered fitness application that may include personalized workout planning, workout tracking, nutrition support, AI trainer chat, exercise form analysis, progress insights, community features, and premium subscription features.

2. Eligibility

• You must be at least 13 years old to use FitBot AI.
• If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian.

3. Accounts

• You agree to provide accurate, current, and complete account information.
• You are responsible for keeping your account credentials secure.
• You are responsible for activity that occurs under your account.
• We may suspend or terminate accounts that violate these Terms or put other users or the Service at risk.

4. Premium Access and Billing

Free Trial

• FitBot AI may offer a free trial period of 3 days for new subscribers.
• At the end of the free trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends.
• You may cancel the free trial at any time through your Apple App Store or Google Play account settings before the trial period expires to avoid being charged.
• Free trial eligibility is limited to one trial per user. If you have previously redeemed a free trial, you may not be eligible for another.

Pricing and Billing

• Prices and billing terms are displayed in the app before purchase.
• Recurring billing applies only when the purchase flow clearly states that a plan renews automatically.

Auto-Renewal

• If a purchase renews automatically, it will continue until you cancel it through the platform you purchased from.
• You will be charged the applicable renewal fee only for plans that are explicitly sold as recurring subscriptions.

Cancellation

• You may cancel an active subscription at any time through your Apple App Store or Google Play account settings.
• If you cancel, access continues until the end of the current billing period unless the platform states otherwise.
• Deleting the app does not cancel an active subscription.

Refunds

• Refunds for App Store or Google Play purchases are handled by Apple or Google under their own policies.
• We do not process app store refunds directly.

5. Acceptable Use

You agree not to:

• Attempt to gain unauthorized access to the Service, its infrastructure, or other user accounts.
• Reverse engineer, disrupt, or abuse the Service.
• Upload illegal, hateful, threatening, sexually explicit, or otherwise inappropriate content.
• Harass, threaten, or harm other users.
• Misuse AI features to generate harmful, deceptive, or abusive content.
• Create multiple accounts to circumvent restrictions or bans.

6. AI and Health Disclaimers

• AI-generated recommendations may not always be accurate, complete, or suitable for your circumstances.
• Always consult a qualified professional before starting a new exercise or nutrition program.
• If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical advice.

7. Community Features

• You are responsible for content you post in community areas.
• We may moderate, remove, or restrict content or accounts that violate these Terms or community rules.
• Reported content may result in warnings, content removal, suspension, or permanent account bans.

8. Account Deletion and Data Retention

• You may delete your account in the app through Settings > Delete Account.
• Account deletion permanently removes your FitBot AI account and associated cloud data, subject to standard backup retention and legal requirements.
• Deleting your account does not automatically cancel an active app store subscription. Cancellation must be handled through your app store account.

9. Intellectual Property

• The FitBot AI app, website, branding, designs, code, and related materials are owned by FitBot AI or its licensors and are protected by applicable law.
• You retain ownership of content you submit, but you grant us a non-exclusive license to use, display, and store that content as necessary to operate the Service.

10. Limitation of Liability

To the fullest extent permitted by law, FitBot AI and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for claims related to the Service will not exceed the amount you paid to us in the twelve months before the claim.

11. Changes to These Terms

• We may update these Terms from time to time.
• We will update the "Last Updated" date when changes take effect.
• Your continued use of FitBot AI after changes take effect constitutes acceptance of the updated Terms.
